Filled in for your situation — an individual (not a registered business) operating this from New York. Still not legal advice, and the arbitration clause below (Section 10) involves minors, which is a genuinely unsettled legal area — have a lawyer confirm it's enforceable before you rely on it.
1. Acceptance of terms
By submitting an audit request, signing in to the Community Panel with Discord, signing in to the reviewer portal, or otherwise using this site, you agree to these terms. If you don't agree, please don't use the service.
2. Who operates this
Velken is operated by an individual based in New York State — this is an independently run project, not a registered company. Contact: me@xyzvu.online.
3. What the service is
Velken lets community owners request a review of their Discord/Roblox community, see their results and request re-audits through the Community Panel, and lets reviewers publish an audit record (score, compliance status, rank, findings) that may be shown publicly. Velken does not guarantee any particular outcome, score, or turnaround time.
4. Eligibility and minors
You must be at least 13 years old to use this service. If you are 13–17, you may use the service with the informed consent described in our Privacy Policy — submitting a request or signing in to the Community Panel as a 13–17 year old is how that consent is given, for the specific purpose of using the feature you're using. If you're under 13, please don't use this service.
5. Your submissions
You're responsible for what you submit through the request form or Community Panel. Don't submit anything illegal, knowingly false, or that infringes someone else's rights. You confirm you have the authority to request a review of the server/organisation you name.
6. Community ratings
The 5-star community rating feature is open to anyone and reflects individual visitors' opinions — it is separate from, and not verified or endorsed as part of, Velken's own audit score. Ratings can't be edited or removed once submitted, including by the person who submitted them.
7. Reviewer and Community Panel accounts
Both reviewers and community owners sign in with Discord — Discord itself verifies who you are, and there's no separate Velken password to create or keep confidential for either. The difference is access, not sign-in method: an admin controls who has reviewer access by granting it to a specific verified Discord account, while Community Panel access is available to anyone who signs in. Everyone is expected to use their access responsibly.
8. Published records
Organisation records marked "published" may be shown publicly (score, category, compliance status, rank, and any testimonial quote). To request a correction or takedown of a published record, contact me@xyzvu.online.
9. Intellectual property
The Velken name, logo, and site design belong to their owner. Content you submit remains yours, but by submitting it you allow Velken to use it to provide the service (e.g., displaying a published record or a submitted rating).
10. No warranty
This service is provided "as is," without warranties of any kind, to the fullest extent the law allows. Velken does not guarantee the accuracy of any audit finding, score, or user-submitted rating.
11. Limitation of liability
To the fullest extent permitted by New York law, Velken and its operator aren't liable for indirect, incidental, or consequential damages arising from use of this service.
12. Dispute resolution — binding arbitration
You and Velken agree to resolve disputes through individual binding arbitration, not in court, and not as part of a class action. Arbitration will be conducted under the rules of a recognized arbitration provider (e.g., the American Arbitration Association), on an individual basis, in New York State, unless both sides agree otherwise. Either side may instead bring an individual claim in small claims court if it qualifies.
A note on this clause and minors: because this service allows users aged 13–17, it's worth knowing that courts in New York and elsewhere have sometimes limited or refused to enforce arbitration clauses against minors, since minors generally have the legal right to "disaffirm" (cancel) contracts they entered into before turning 18. This clause is included because it was requested, but its enforceability against a minor user specifically has not been confirmed by a lawyer — treat it as untested until it is.
13. Termination
Access to the reviewer portal or Community Panel may be suspended or removed at any time, for any reason, particularly for misuse.
14. Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules, except where Section 12 requires arbitration instead of a court proceeding.
15. Changes to these terms
We may update these terms from time to time. Continued use of the service after a change means you accept the updated terms.
